Agencio APAC Pte Ltd Acceptable Use Policy (AUP) for Agencio Cloud BethaMagic Brand as a Service

Applies to: All users of Agencio Cloud and BerthaMagic, the SaaS "Brand as a Service" platform offered by Agencio APAC Pte Ltd

 

 

 

 1. Purpose and Scope

 

 1.1 Purpose

 

This Acceptable Use Policy ("AUP") outlines the rules, restrictions, and responsibilities governing the use of Agencio Cloud and its integrated services. The purpose of this policy is to:

 

- Protect Platform Integrity: Ensure the security, stability, and availability of Agencio Cloud for all users

- Ensure Lawful Use: Guarantee that all activities comply with applicable laws, regulations, and industry standards

- Maintain Compliance: Ensure adherence to third-party platform policies, including TikTok, Meta, Google, and other integrated services

- Foster Trust: Create a safe, ethical, and compliant environment for all customers and partners

- Protect Users: Safeguard user data, privacy, and rights across all platform features

 

 1.2 Scope

 

This AUP applies to:

 

All Users:

- Customer accounts and authorized users

- Account administrators and team members

- Free tier, professional, and enterprise users

- Trial and evaluation accounts

 

All Activities:

- Data, content, campaigns, and creative assets created, uploaded, or transmitted through the Service

- Use of third-party integrations including TikTok, Meta, Google, LinkedIn, Twitter/X, and other platforms

- AI-generated content using OpenAI, Anthropic, RunwayML, Stability AI, and other AI services

- API usage and programmatic access

- Marketing automation and campaign management

- Social media posting and content distribution

 

All Infrastructure:

- AWS-hosted services and infrastructure

- Third-party service provider integrations

- API endpoints and developer tools

 

 1.3 Acceptance and Binding Effect

 

Use of Agencio Cloud constitutes your acceptance of this AUP. This policy is incorporated into and forms part of our [Terms of Service](https://www.agencio.cloud/general-8). Violation of this AUP is a violation of the Terms of Service and may result in immediate suspension or termination of your account.

 

 

 

 2. Prohibited Activities

 

Users must not use Agencio Cloud to engage in any unlawful, harmful, abusive, fraudulent, or unethical activity. The following activities are strictly prohibited:

 

 2.1 Illegal or Harmful Activities

 

Absolutely Prohibited:

 

1. Criminal Activities:

   - Violating any applicable local, national, or international laws

   - Facilitating or promoting illegal activities

   - Money laundering or financial fraud

   - Drug trafficking or illegal substance promotion

   - Weapons trafficking or illegal weapons sales

   - Human trafficking or exploitation

 

2. Harmful Content:

   - Uploading, distributing, or promoting content that is:

     - Threatening, harassing, bullying, or abusive

     - Defamatory, libelous, or slanderous

     - Fraudulent or deliberately misleading

     - Promoting violence, hatred, or discrimination

     - Exploitative of minors or vulnerable individuals

     - Sexually explicit or pornographic (except where explicitly legal and permitted)

 

3. Malicious Software:

   - Distributing malware, ransomware, viruses, trojans, or worms

   - Creating or distributing spyware or keyloggers

   - Developing or sharing exploit code

   - Distributing tools designed to compromise security

   - Phishing or social engineering attacks

 

4. Dangerous Activities:

   - Promoting self-harm, suicide, or eating disorders

   - Distributing instructions for creating weapons or explosives

   - Promoting dangerous challenges or stunts

   - Sharing graphic violence or gore

   - Facilitating illegal gambling

 

 2.2 Third-Party Platform Policy Violations

 

You must comply with all policies of platforms integrated with our Service. This includes, but is not limited to:

 

 2.2.1 TikTok Platform Violations

 

Strictly Prohibited on TikTok Integration:

 

1. Community Guidelines Violations:

   - Violating [TikTok Community Guidelines](https://www.tiktok.com/community-guidelines) in any content posted

   - Dangerous acts or challenges

   - Hateful or discriminatory content

   - Spam, fake engagement, or artificial traffic

   - Promoting dangerous organizations or individuals

   - Misleading information or misinformation

 

2. Content Integrity Violations:

   - Removing or altering TikTok watermarks from videos without explicit creator consent

   - Stripping creator attribution from TikTok content

   - Reposting TikTok content without proper credit

   - Claiming ownership of others' TikTok content

   - Downloading TikTok videos for unauthorized redistribution

 

3. Inauthentic Behavior:

   - Creating fake accounts or impersonating others

   - Artificially inflating views, likes, followers, or engagement

   - Using bots or automated tools for engagement

   - Coordinated inauthentic behavior

   - Misleading others about account identity or purpose

 

4. TikTok Brand Violations:

   - Violating [TikTok Brand and Use Guidelines](https://tiktokbrandbook.com/d/HhXfjVK1Poj9/legal)

   - Misusing TikTok logos, trademarks, or branding

   - Implying false affiliation or endorsement by TikTok

   - Using "TikTok" in misleading ways in app or company names

 

5. Data Misuse:

   - Scraping TikTok data beyond authorized API access

   - Using TikTok data for unauthorized purposes

   - Sharing TikTok user data without proper consent

   - Creating databases or profiles of TikTok users without authorization

   - Using TikTok data to train competing AI models

 

6. Commercial Violations:

   - Violating TikTok advertising policies

   - Promoting prohibited products or services

   - Deceptive advertising or marketing practices

   - Circumventing TikTok's monetization systems

 

 2.2.2 Meta Platform Violations (Facebook & Instagram)

 

Prohibited Activities on Meta Platforms:

 

1. Community Standards:

   - Violating [Meta Community Standards](https://transparency.fb.com/policies/community-standards/)

   - Hate speech or discriminatory content

   - Violence and incitement

   - Bullying and harassment

   - Coordinated harmful activity

 

2. Advertising Policies:

   - Violating [Meta Advertising Policies](https://www.facebook.com/policies/ads/)

   - Promoting prohibited products (weapons, tobacco, adult content)

   - Misleading claims or scams

   - Low-quality or disruptive content

   - Circumventing ad review systems

 

3. Authenticity:

   - Creating fake accounts or pages

   - Misrepresenting identity or affiliations

   - Coordinated inauthentic behavior

   - Spam or fake engagement

 

4. Data Use:

   - Violating [Meta Platform Terms](https://developers.facebook.com/terms)

   - Scraping data beyond API permissions

   - Using data for facial recognition without consent

   - Selling or transferring user data

 

 2.2.3 Google Platform Violations

 

Prohibited on Google Services:

 

1. Google Ads Policies:

   - Prohibited content (dangerous products, dishonest behavior)

   - Restricted content without proper certification

   - Misrepresentation or misleading claims

 

2. YouTube Terms:

   - Violating [YouTube Terms of Service](https://www.youtube.com/t/terms)

   - Copyright infringement

   - Spam, misleading metadata, or scams

   - Hate speech or harassment

   - Violent or graphic content

 

3. Google API Policies:

   - Violating [Google API Services User Data Policy](https://developers.google.com/terms/api-services-user-data-policy)

   - Unauthorized data collection or scraping

   - Misusing user data

   - Inadequate data security

 

 2.2.4 Other Platform Violations

 

LinkedIn:

- Professional community standards violations

- Fake profiles or misleading credentials

- Spam or unsolicited messaging

- Scraping data beyond API access

 

Twitter/X:

- Platform manipulation or spam

- Abusive behavior or harassment

- Hateful conduct

- Violent content

 

General Platform Compliance:

- You must comply with the terms, policies, and guidelines of all platforms you connect to our Service

- Violations of any platform's policies through our Service are violations of this AUP

- You are responsible for staying informed about platform policy updates

 

 2.3 Intellectual Property Violations

 

Strictly Prohibited:

 

1. Copyright Infringement:

   - Uploading or distributing copyrighted content without authorization

   - Using images, videos, music, or text without proper licensing

   - Circumventing content protection mechanisms

   - Removing copyright notices or attributions

   - Creating derivative works without permission

 

2. Trademark Violations:

   - Using others' trademarks without authorization

   - Creating confusion about brand affiliation

   - Counterfeiting or passing off

   - Domain squatting or cybersquatting

   - Misusing company names or logos

 

3. Agencio IP Violations:

   - Reverse engineering our software or APIs

   - Copying or stealing our proprietary algorithms

   - Misusing our trademarks or branding

   - Unauthorized redistribution of our software

   - Creating competing services using our IP

 

4. License Violations:

   - Using AI-generated content beyond granted licenses

   - Violating open-source licenses

   - Exceeding scope of software licenses

   - Using trial software beyond evaluation period

 

5. Plagiarism:

   - Copying others' content and claiming as your own

   - Not providing proper attribution where required

   - Academic or professional plagiarism

 

 2.4 Unauthorized Access & Security Violations

 

Absolutely Prohibited:

 

1. Account Security:

   - Attempting to access others' accounts without authorization

   - Sharing account credentials inappropriately

   - Selling or transferring accounts

   - Creating multiple accounts to circumvent restrictions

 

2. System Security:

   - Attempting to bypass, disable, or interfere with security features

   - Exploiting vulnerabilities in Agencio Cloud or AWS infrastructure

   - Attempting to gain unauthorized access to systems or data

   - Intercepting or monitoring data transmission without authorization

   - Deploying backdoors or persistent access mechanisms

 

3. Testing Without Authorization:

   - Penetration testing without written approval from legal@agencio.cloud

   - Vulnerability scanning without prior authorization

   - Load testing or stress testing without coordination

   - Security research without coordinated disclosure

   - DDoS attacks or denial of service attempts

 

4. Data Breaches:

   - Attempting to access data you're not authorized to view

   - Exploiting bugs to access restricted features

   - Circumventing role-based access controls

   - Unauthorized data exports or downloads

   - Sharing access to systems or data inappropriately

 

5. Identity Fraud:

   - Using false or misleading identity information

   - Impersonating others or organizations

   - Creating accounts with fake credentials

   - Falsifying verification documents

   - Misrepresenting organizational affiliations

 

 2.5 Spam, Abuse, and Manipulation

 

Prohibited Activities:

 

1. Spam and Bulk Messaging:

   - Sending unsolicited bulk messages or emails (spam)

   - Automated messaging without recipient consent

   - Chain letters or pyramid schemes

   - Excessive posting or flooding

   - Comment spam or fake reviews

 

2. Engagement Manipulation:

   - Artificially inflating likes, views, shares, or followers

   - Using bots or automated tools for social engagement

   - Coordinated inauthentic behavior

   - Click fraud or impression fraud

   - Fake reviews or testimonials

 

3. Platform Manipulation:

   - Circumventing rate limits or API restrictions

   - Using multiple accounts to evade restrictions

   - Exploiting bugs for unfair advantage

   - Manipulating algorithms or recommendation systems

   - Gaming metrics or analytics

 

4. Deceptive Practices:

   - Phishing or credential harvesting

   - Creating fake websites or pages

   - Misleading clickbait or sensationalism

   - False advertising or bait-and-switch

   - Impersonation or catfishing

 

5. Harassment and Abuse:

   - Stalking or persistent unwanted contact

   - Doxxing (publishing private information)

   - Brigading or coordinated harassment

   - Death threats or violent threats

   - Sexual harassment or unwanted advances

 

 2.6 Data Misuse and Privacy Violations

 

Strictly Prohibited:

 

1. Personal Data Violations:

   - Processing personal data without lawful basis or consent

   - Collecting more data than necessary for stated purpose

   - Using data for purposes not disclosed to users

   - Selling or renting personal data without explicit consent

   - Sharing data with third parties without authorization

 

2. Regulatory Violations:

   - Violating GDPR (General Data Protection Regulation) for EU users

   - Violating CCPA/CPRA (California Consumer Privacy Act) for California users

   - Violating PDPA (Personal Data Protection Act) for Singapore users

   - Non-compliance with other applicable privacy laws

   - Failing to honor data subject rights requests

 

3. Children's Data:

   - Collecting data from children under 13 (or applicable age) without proper consent

   - Processing children's data without COPPA compliance

   - Targeting marketing to minors inappropriately

   - Creating profiles of minors without parental consent

 

4. Sensitive Data:

   - Processing sensitive personal data (health, biometric, financial) without proper safeguards

   - Collecting protected health information (PHI) without HIPAA compliance

   - Processing biometric data without clear consent and security

   - Collecting financial data without PCI DSS compliance

 

5. Data Security Failures:

   - Storing data without proper encryption

   - Failing to implement reasonable security measures

   - Not reporting data breaches as required by law

   - Sharing credentials or access inappropriately

   - Leaving data exposed or unsecured

 

6. Surveillance and Tracking:

   - Unauthorized surveillance or monitoring

   - Tracking users without proper disclosure and consent

   - Using personal data for discriminatory profiling

   - Creating shadow profiles of non-users

   - Excessive or unnecessary data retention

 

 2.7 Resource Misuse and Service Abuse

 

Prohibited Activities:

 

1. API and System Abuse:

   - Exceeding API rate limits or quotas

   - Making abusive or excessive API calls

   - Using automated scripts to overload systems

   - Running cryptocurrency mining on our infrastructure

   - Using our service for proxy or VPN purposes

 

2. Computational Abuse:

   - Using service for purposes it wasn't designed for

   - Running unauthorized background processes

   - Consuming excessive computational resources

   - Interfering with other users' service quality

   - Hosting file sharing or torrent services

 

3. Denial of Service:

   - Launching DDoS attacks against our service or others

   - Intentionally causing system outages

   - Resource exhaustion attacks

   - Application-layer attacks

   - Amplification attacks

 

4. Network Abuse:

   - Port scanning without authorization

   - Network sniffing or packet interception

   - Man-in-the-middle attacks

   - DNS attacks or cache poisoning

   - BGP hijacking or route manipulation

 

 2.8 AI and Content Generation Misuse

 

Prohibited Uses of AI Features:

 

1. Harmful AI Content:

   - Generating deepfakes without disclosure and consent

   - Creating misleading or false media

   - Generating hate speech or discriminatory content

   - Creating content that violates platform policies

   - Producing misinformation or disinformation

 

2. Unlawful AI Use:

   - Generating content that infringes copyrights

   - Creating fraudulent documents or identities

   - Producing illegal content (CSAM, terrorism, etc.)

   - Generating content for illegal purposes

   - Bypassing content safety filters

 

3. Unethical AI Practices:

   - Using AI to manipulate or deceive users

   - Creating content without proper disclosure of AI generation

   - Generating content for harassment or abuse

   - Using AI to create fake personas or identities

   - Bypassing human verification systems with AI

 

4. AI Training Misuse:

   - Using our AI features to train competing models

   - Extracting or reverse engineering AI models

   - Systematic data harvesting from AI outputs

   - Using AI-generated content to game algorithms

 

 2.9 Financial and Commercial Violations

 

Prohibited Activities:

 

1. Fraudulent Transactions:

   - Credit card fraud or payment fraud

   - Chargeback fraud or abuse

   - Money laundering activities

   - Using stolen payment methods

   - Refund abuse or gaming

 

2. Deceptive Commercial Practices:

   - False advertising or misleading claims

   - Bait-and-switch tactics

   - Pyramid schemes or multi-level marketing scams

   - Investment fraud or Ponzi schemes

   - Cryptocurrency scams

 

3. Prohibited Products/Services:

   - Illegal drugs or controlled substances

   - Weapons or explosives

   - Counterfeit goods

   - Stolen goods or property

   - Illegal gambling services

 

4. Financial Regulation Violations:

   - Operating without required licenses

   - Violating securities laws

   - Non-compliance with AML/KYC requirements

   - Tax evasion or fraud

   - Sanctions violations

 

 

 

 3. Customer Responsibilities

 

You are responsible for all activity under your account and must:

 

 3.1 Account Security Responsibilities

 

You Must:

 

1. Protect Your Credentials:

   - Maintain confidentiality of login credentials

   - Use strong, unique passwords

   - Enable multi-factor authentication (MFA)

   - Never share passwords with others

   - Change passwords immediately if compromised

 

2. Monitor Account Activity:

   - Regularly review account activity and logs

   - Monitor for unauthorized access or suspicious behavior

   - Review connected third-party integrations periodically

   - Check API usage and ensure it's legitimate

   - Audit team member access and permissions

 

3. Report Security Issues:

   - Immediately notify us at security@agencio.cloud of any:

     - Suspected compromise or unauthorized access

     - Security vulnerabilities discovered

     - Data breaches or leaks

     - Suspicious activities or anomalies

     - Lost or stolen devices with account access

 

4. Secure Connected Platforms:

   - Secure your TikTok, Meta, Google, and other platform accounts

   - Use strong authentication for all connected services

   - Regularly review and revoke unnecessary permissions

   - Protect OAuth tokens and refresh tokens

   - Don't share platform credentials

 

 3.2 Data Compliance Responsibilities

 

You Are Responsible For:

 

1. Lawful Data Processing:

   - Ensuring all uploaded or processed data is collected lawfully

   - Obtaining required consents for personal data processing

   - Having legal basis for all data processing activities

   - Complying with applicable privacy laws (GDPR, CCPA, PDPA, etc.)

   - Maintaining data processing records as required

 

2. User Rights Management:

   - Honoring user data access requests

   - Processing data deletion requests

   - Responding to data correction requests

   - Managing user consent and opt-outs

   - Providing required privacy notices

 

3. Data Security:

   - Implementing appropriate technical and organizational measures

   - Encrypting sensitive data before upload (where appropriate)

   - Following data minimization principles

   - Establishing data retention and deletion schedules

   - Training team members on data protection

 

4. Third-Party Data:

   - Only uploading data you have rights to use

   - Respecting data use restrictions and licenses

   - Not uploading others' data without permission

   - Complying with platform-specific data policies

   - Maintaining audit trails for data processing

 

 3.3 Content Compliance Responsibilities

 

You Must Ensure:

 

1. Content Ownership and Rights:

   - You own or have rights to all content uploaded

   - All content complies with applicable laws

   - Proper licensing for music, images, videos, and other media

   - Attribution and credits where required

   - Rights to use brand assets and trademarks

 

2. Platform Policy Compliance:

   - Content complies with TikTok Community Guidelines

   - Content meets Meta Community Standards

   - Content follows Google Ads Policies

   - Content adheres to all connected platform policies

   - Regular review of platform policy updates

 

3. Marketing Compliance:

   - Advertising complies with FTC guidelines

   - Disclosures for sponsored content and partnerships

   - CAN-SPAM compliance for email marketing

   - TCPA compliance for SMS/text marketing

   - Truth in advertising standards

 

4. Industry-Specific Regulations:

   - Healthcare: HIPAA compliance

   - Finance: SEC regulations, FINRA rules

   - Children's products: COPPA compliance

   - Alcohol/tobacco: Age-gating and restrictions

   - Other industry-specific regulations applicable to your business

 

 3.4 Ethical Marketing Practices

 

You Agree To:

 

1. Transparency and Honesty:

   - Not creating misleading or deceptive content

   - Clearly disclosing AI-generated content where required

   - Being honest about product claims and benefits

   - Disclosing material connections and sponsorships

   - Not manipulating reviews or testimonials

 

2. Respect for Users:

   - Respecting user preferences and opt-outs

   - Not sending unsolicited communications

   - Honoring unsubscribe requests promptly

   - Not manipulating or deceiving users

   - Providing clear value propositions

 

3. Fair Competition:

   - Not engaging in unfair competitive practices

   - Not making false claims about competitors

   - Not using others' trademarks inappropriately

   - Competing fairly and ethically

   - Respecting market regulations

 

4. Social Responsibility:

   - Not promoting harmful products or behaviors

   - Considering social and environmental impact

   - Not exploiting vulnerable populations

   - Promoting diversity and inclusion

   - Being mindful of cultural sensitivities

 

 3.5 Technical Responsibilities

 

You Must:

 

1. API Usage:

   - Use APIs responsibly within rate limits

   - Implement proper error handling

   - Cache data appropriately to reduce unnecessary calls

   - Follow API best practices and documentation

   - Report API issues or bugs discovered

 

2. Integration Management:

   - Keep integrations up to date

   - Test campaigns before full deployment

   - Monitor integration performance

   - Disconnect unused integrations

   - Respond to platform API deprecations

 

3. System Compatibility:

   - Use supported browsers and devices

   - Keep systems updated and patched

   - Ensure network security

   - Use compatible file formats

   - Meet technical requirements for features

 

 

 

 4. Platform Rights and Enforcement

 

 4.1 Monitoring and Investigation

 

We Reserve the Right To:

 

1. Activity Monitoring:

   - Monitor platform usage to ensure compliance with this AUP

   - Review API usage patterns and detect abuse

   - Analyze system logs for security purposes

   - Investigate suspected violations

   - Conduct automated scanning for prohibited content

 

2. Content Review:

   - Review content for policy compliance (randomly or triggered by reports)

   - Use automated tools to detect prohibited content

   - Review reported content and complaints

   - Investigate intellectual property claims

   - Scan for malware or malicious content

 

3. Privacy Protections:

   - We do NOT routinely monitor the substance of your content

   - Monitoring is limited to compliance, security, and incident investigation

   - We respect your privacy and confidentiality

   - Access to customer data is restricted and logged

   - We follow our own Privacy Policy in all monitoring activities

 

 4.2 Enforcement Actions

 

Violations of this AUP may result in:

 

1. Warning and Remediation:

   - Written warning with specific violation details

   - Request to remove violating content or cease activity

   - Opportunity to remediate within specified timeframe

   - Educational guidance on policy compliance

   - Probationary monitoring period

 

2. Service Restrictions:

   - Temporary suspension of specific features

   - Disabling of problematic integrations

   - Rate limiting or API restrictions

   - Reduced functionality or access

   - Freezing of account pending investigation

 

3. Account Suspension:

   - Temporary suspension of account access (typically 7-30 days)

   - Access to data export tools during suspension

   - Clear conditions for reinstatement

   - Opportunity to appeal suspension decision

   - Extended suspension for repeat violations

 

4. Account Termination:

   - Permanent termination of account

   - No refund of paid subscriptions

   - Deletion of data per our retention policy

   - Blacklisting of associated accounts or businesses

   - Reporting to third-party platforms if their policies violated

 

5. Legal Action:

   - Reporting illegal activity to law enforcement

   - Cooperation with legal investigations

   - Civil action for damages or breach of contract

   - Injunctive relief for ongoing harm

   - Recovery of costs and attorney fees

 

Factors Considered in Enforcement:

 

- Severity of violation

- Intent (accidental vs. deliberate)

- History of compliance (first-time vs. repeat offender)

- Impact on other users or platform

- Responsiveness to warnings

- Cooperation with investigation

- Steps taken to remediate

- Risk to platform security or integrity

 

Immediate Action Circumstances:

 

We may take immediate action without warning if:

- Violation threatens platform security or integrity

- Illegal activity is detected

- Third-party platform relationships at risk

- User safety is compromised

- Legal obligations require immediate action

- Severe terms of service violations occur

 

 4.3 Appeals Process

 

If You Disagree With Enforcement Action:

 

1. Submit an Appeal:

   - Email: appeals@agencio.cloud

   - Subject: "AUP Enforcement Appeal - [Account ID]"

   - Include: Account details, explanation, evidence

   - Response: Within 5-10 business days

 

2. Appeal Review:

   - Independent review by different team member

   - Consideration of new evidence or context

   - Fair and impartial evaluation

   - Clear explanation of decision

 

3. Appeal Outcomes:

   - Action upheld (with explanation)

   - Action modified (partial remedy)

   - Action reversed (full reinstatement)

   - Additional conditions imposed

 

Appeals are final. Repeated frivolous appeals may result in permanent ban.

 

 

 

 5. Third-Party Services and Integrations

 

 5.1 Platform Compliance Requirements

 

When using third-party integrations, you must comply with each platform's policies:

You Must:

2. Respect Content Integrity:

   - Do NOT remove TikTok watermarks

   - Maintain creator attribution

   - Only post content you have rights to use

   - Respect original creator ownership

 

3. Use Data Appropriately:

   - Use TikTok data only for authorized purposes

 5.2 Integration Misuse Consequences

 

Misuse of Third-Party Integrations May Result In:

 

1. Our Actions:

   - Suspension of specific integration access

   - Removal of integration capability

   - Account suspension or termination

   - Reporting to the affected platform

 

2. Platform Actions:

   - Platform may suspend or terminate your account

   - Loss of API access

   - Permanent ban from platform

   - Legal action by platform

 

You acknowledge that:

- Violations may affect your standing with platforms beyond our control

- We are not responsible for actions taken by third-party platforms

- Platform violations through our Service violate this AUP

- You may lose access to multiple platforms if violations are severe

 

 5.3 Platform Change Adaptation

 

You Acknowledge:

 

- Third-party platforms may change policies, APIs, or features at any time

- We will make reasonable efforts to adapt to platform changes

- Some features may become unavailable due to platform changes

- We are not liable for functionality loss due to platform changes

- You must adapt to platform changes and update content/practices accordingly

When a Violation is Reported:

 

1. Initial Review: Within 48 hours

   - Triage and priority assessment

   - Assignment to appropriate team

 

2. Investigation: Within 5-10 business days

   - Evidence gathering and analysis

   - Account and activity review

   - Contact with involved parties if needed

 

3. Decision and Action: Within 10-15 business days

   - Determination of violation (if any)

   - Appropriate enforcement action

   - Notification to reporter (subject to privacy)

 

Reporter Protection:

- Reports can be made anonymously

- We protect reporter identity in investigations

- No retaliation against good-faith reporters

- False or malicious reports may result in action against reporter

 

 6.3 Cooperation with Investigations

 

You Agree To:

 

1. Cooperate with Investigations:

   - Respond promptly to information requests

   - Provide access to relevant information

   - Not interfere with investigation

   - Be truthful and complete in responses

 

2. Preservation of Evidence:

   - Not delete or alter relevant evidence

   - Preserve logs and records as requested

   - Provide data exports if needed

 

Failure to cooperate may result in adverse inferences or enforcement actions.

 

 

 

 7. Changes to This Policy

 

 7.1 Right to Modify

 

Agencio APAC may update this AUP from time to time to reflect:

 

- Changes in applicable laws or regulations

- Changes in third-party platform requirements

- New features or services

- Emerging threats or abuse patterns

- User feedback and best practices

- Updates to security practices

 

 7.2 Notice of Changes

 

Material Changes:

- Email notification to registered email address

- Prominent notice on website and in-app

- At least 30 days' notice before effective date

- Summary of key changes provided

 

Non-Material Changes:

- Updated version posted immediately

- "Last Updated" date modified

- Notification not required

 

 7.3 Acceptance of Changes

 

Continued use of Agencio Cloud after changes take effect constitutes acceptance of the updated AUP.

 

If you do not agree with changes:

- You may terminate your account before changes take effect

Key terms used in this AUP:

 

"Service": Agencio Cloud and BerthaMagic platform, including all features, integrations, and APIs.

 

"User": Any person or entity with an account or access to the Service.

 

"Content": Any data, text, images, videos, campaigns, or materials created, uploaded, or transmitted through the Service.

 

"Platform" or "Third-Party Platform": External services integrated with our Service, including TikTok, Meta, Google, LinkedIn, Twitter/X, etc.

 

"AUP": This Acceptable Use Policy document.

 

"We," "Us," "Our": Agencio APAC Pte Ltd and its affiliates.

 

"API": Application Programming Interface used for programmatic access to the Service or third-party platforms.

 

"AI Services": Artificial intelligence services including OpenAI, Anthropic, RunwayML, and Stability AI integrated with our Service.

 

"Personal Data": Information relating to an identified or identifiable individual.

 

 

 

 10. Legal Effect and Incorporation

 

 10.1 Binding Agreement

 

This Acceptable Use Policy is a binding agreement between you and Agencio APAC Pte Ltd. By using the Service, you agree to be bound by this AUP.
